The Asylum procedure advice for minors, their parents, guardians and godparents as part of the AMIF project "Development and implementation of quality standards in the reception of asylum seekers" is aimed at:

  • Accompanied and unaccompanied minor asylum seekers in the asylum procedure
  • Accompanied and unaccompanied minors who have been rejected as asylum seekers who want to take legal action against the BAMF rejection decision or who are already in the process of taking legal action,
  • Accompanied and unaccompanied minors entitled to subsidiary protection who want to take legal action against the BAMF partial rejection decision or who are already in the process of taking legal action.
The procedural advice includes:

  • Explanation of the asylum procedure,
  • Explanation of the material requirements for the individual protection titles in the asylum procedure,
  • Explanation of special procedural guarantees for particularly vulnerable persons in accordance with EU Directive (2013/32/EU (Asylum Procedures Directive), in the case of unaccompanied minor asylum seekers, consideration and inclusion of multiple needs for protection,
  • Child-friendly, therefore time-consuming preparation and follow-up of the asylum hearing: targeted preparation for the hearing enables the BAMF’s special representative for unaccompanied underage asylum seekers to carry out the hearing efficiently, qualitatively and in a focused manner to record the reasons for fleeing in the interest of the child’s well-being,
  • Explanation of the positive/negative legal consequences of BAMF decisions,
  • Explanation of possible legal remedies against (partial) refusals,
  • Assistance in filing legal remedies (lawsuit and application for summary legal protection)
  • Discussion of the legal situation with the project lawyer; if necessary, representation by a lawyer,
  • if necessary, support in submitting a follow-up application,
  • Support in filing legal remedies (complaint and § 80V application, if necessary consideration of status reports and court decisions), in particular on child-specific reasons for fleeing.
  • culturally sensitive educational and family counseling,
  • Advice and support for applying for help with education and obligations to cooperate (help plan procedures, integration aids, extended youth welfare for young adults).
